Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FieldBuilt CRM platform, website, and services provided by FieldBuilt CRM, Inc. ("FieldBuilt," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing our platform, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services.

If you are using our services on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

2. Description of Services

FieldBuilt CRM provides a customer relationship management platform designed for field service businesses. Our services include, but are not limited to:

  • CRM tools for managing customer contacts, leads, and deals
  • Automated marketing and communication workflows
  • SMS and email messaging capabilities
  • Appointment scheduling and reminder systems
  • Reporting and analytics dashboards
  • Integration with third-party tools and services

3. SMS Messaging Terms

FieldBuilt CRM enables businesses on our platform to send SMS messages to their customers. By using our SMS features, you (as a business operator) agree to the following:

Consent Requirement: You must obtain prior express written consent from recipients before sending them marketing or promotional SMS messages. For informational messages such as appointment reminders, you must have an established business relationship and have clearly disclosed that you may send text messages.

Required Disclosures: All SMS opt-in flows must include: the business name, a description of message types, message frequency disclosure, "Message and data rates may apply" language, STOP opt-out instructions, and HELP instructions with a link or reference to Terms and Privacy Policy.

Opt-Out Compliance: You must honor all STOP requests immediately and maintain suppression lists. Recipients who reply STOP must not receive further messages from your account.

Message and Data Rates: Message and data rates may apply to recipients depending on their mobile carrier and service plan.

Message Frequency: Message frequency varies by business use case. Typical use includes appointment reminders and follow-up communications sent on an as-needed basis.

Non-Sharing of Mobile Numbers: Mobile phone numbers collected through the platform are not shared with third parties for their own marketing purposes.

Opt-Out Instructions: Recipients may reply STOP to opt out at any time. For help, recipients may reply HELP or contact FieldBuilt CRM at (833) 573-4353.

4. Account Registration and Security

To use our services, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring your account information remains accurate and up to date

5. Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Send unsolicited messages (spam) or messages to individuals who have not consented
  • Violate any applicable laws, including CAN-SPAM, TCPA, and carrier regulations
  • Use our platform to harass, abuse, or harm others
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Transmit malicious code, viruses, or other harmful content
  • Resell or sublicense our services without prior written consent
  • Use our services to send content related to illegal activities

6. Subscription Plans and Payment

SaaS Subscriptions

Our SaaS plans are billed on a monthly basis. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Prices are subject to change with 30 days' notice.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting our support team. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.

Enterprise License

Enterprise licenses are subject to a separate Enterprise License Agreement. Contact us at [email protected] for Enterprise pricing and terms.

7. Intellectual Property

FieldBuilt CRM and its content, features, and functionality are owned by FieldBuilt CRM, Inc. and are protected by copyright, trademark, and other intellectual property laws. For SaaS subscribers, we grant a limited, non-exclusive, non-transferable license to use our platform for your business purposes.

You retain ownership of all data and content you upload to our platform. By uploading content, you grant us a license to use that content solely to provide our services to you.

8. Data and Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our data practices as described in the Privacy Policy.

You are responsible for ensuring that your use of our platform complies with all applicable privacy laws, including obtaining necessary consents from your customers before sending them communications.

9. Third-Party Integrations

Our platform integrates with third-party services. Your use of these integrations is subject to the third party's own terms of service and privacy policies. We are not responsible for third-party services or their practices.

10. Disclaimers and Limitation of Liability

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure.

To the maximum extent permitted by law, FieldBuilt CRM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

11. Indemnification

You agree to indemnify, defend, and hold harmless FieldBuilt CRM, Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of our services, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms, failure to pay, or for any other reason at our discretion. Upon termination, your right to use our services ceases immediately. We will provide you with a reasonable opportunity to export your data upon termination unless the termination is for cause.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our platform. Your continued use of our services after changes become effective constitutes acceptance of the updated Terms.
